3. You are entitled to be evaluated by a licensed health care provider, regardless of the extent of your injuries.
4. Regardless of which party is at fault, your Florida PIP auto insurance will pay up to $10,000.00 for necessary medical treatment.
5. The sooner you seek treatment, the sooner your problems with be addressed.
6. If you need legal advice and you don't know who to ask, our many years experience with the legal community relating to car accidents and other types of accidents in this area, can recommend a few very good and competent lawyers that may advise you at no cost to you.
... YOU SHOULD SEEK COUNSEL.
Why?
Because once you settle your case, you lose the right to have your insurance company pay for treatment if you need it. A good rule of thumb is to be informed of your rights and then make a decision. It is our position that if you were indeed injured, you should get the care you need to get you back to the way you felt and functioned just before the accident.
It is not the responsibility of the insurance company to pay for anything more than that. They are not responsibile for pre-existing injuries; only the injuries sustained from the accident. Even if you are just sore, you should get checked out immediately because you may experience pain, numbness, headaches, muscle stiffness, fatigue, and other problems including arthritis many months down the road. Remember, nothing is more important than your health, especially when you start to lose it.
HERE'S WHERE THE PROBLEM BEGINS...
Most people who suffer from an auto accident have one thing on their mind: their automobile!
Common questions include:
1. "Who is going to fix my car?"
2. "What will I drive in the mean time?"
3. "Will my insurance rates go up?"
4. "Who is going to pay for it?"
And the last thing on their mind is: "Am I Really O.K.?"
CONSULTING WITH A CAR ACCIDENT LAWYER
If you have been hurt in a car accident, the first thing you should do after an auto accident with injury is to get assessed by a doctor and get medical treatment for your injuries. If you are insured in Florida, a state which has a no-fault law for no fault auto accidents, then your medical treatment will be covered by your own insurance company for up to the maximum of 10,000 dollars. It is always best to seek medical treatment before consulting an attorney because the insurance company, and a jury if your case goes to trial, will be very suspicious of anyone who goes to his attorney before going to a doctor for an auto insurance injury claim. WHIPLASH
Whiplash is a non-medical term used to describe neck pain following an injury to the soft tissues of your neck (specifically ligaments, tendons, and muscles). It is caused by an abnormal motion or force applied to your neck that causes movement beyond the neck's normal range of motion.
Whiplash happens in motor vehicle accidents such as car crashes, auto accidents, and truck accidents, as well as during sporting activities, accidental falls, and assault.
WHIPLASH CAUSES
The most frequent cause of whiplash is a car accident. The speed of the cars involved in the accident or the amount of physical damage to the car may not relate to the intensity of neck injury; speeds as low as 15 miles per hour can produce enough energy to cause whiplash in occupants, whether or not they wear seat belts.
Other common causes of whiplash include contact sport injuries and blows to the head from a falling object or being assaulted. Also, Repetitive stress injuries or chronic strain involving the neck (such as using your neck to hold the phone) are a common, non-acute causes.

DO YOU HAVE WHIPLASH ?
You were in that car accident last week and ever since then your neck has been stiff and sore, you keep having periodic bouts of dizziness, and you just can’t get rid of that headache! It wasn’t a serious car accident- you were only going 10 miles and hour! Could that have caused whiplash?
Sudden acceleration of the head can often cause injury to the cervical vertebrae and surrounding tissues. This injury is called a neck sprain, neck strain, or whiplash. Anything that causes a sudden backward or forward jerking motion of the head can cause whiplash. This includes even car accidents as slow as 5 MPH.
Not all passengers in the same accident will likely be injured in the same manner. You may have a bad case of whiplash, while the person next to you did not get hurt at all. The duration of whiplash injury can also vary widely. In some instances, pain will disappear after a few days, while in others it will last for up to three months. Sometimes symptoms will resurface after having been gone for several weeks.
Some of the common treatments for whiplash are pain medications, nonsteroidal anti-inflammatory drugs, antidepressants, muscle relaxants, and a cervical collar (usually worn for 2 to 3 weeks). Sometimes these treatments are enough to allow the body to heal itself, but unfortunately, these treatments often only mask symptoms, which reappear after the medication is stopped. To get to root of the problem, range of motion exercises, physical therapy, therapeutic massage and chiropractic care are required.
A recent study suggests that the most effective treatment of whiplash is an early and active care plan. “Standard” treatment involves the patient performing exercises a few times a day, beginning two weeks after the accident. “Active” treatment means exercises performed at home by the patient ten times an hour. When started within four days of the injury, patients on “active” treatment were seven times more likely than those following the standard treatment to report complete relief of symptoms at six months.
In addition to prescribing exercises to help restore your muscles, your chiropractor will adjust the vertebrae in your spine, especially your neck, returning them to their proper positions. This will help relieve stretched muscles, avoid pressure on nerves, and help restore spinal function – helping to accelerate your recovery.
Your chiropractor may also apply heat and or ice therapy to relieve muscle tension, and / or refer you to a licensed massage therapist.
Often someone’s neck pain and headaches, caused by the original accident, will continue indefinitely. These victims of “chronic whiplash syndrome” usually do not find relief with any conventional treatment. Several scientific studies indicate that chiropractic care is especially effective in these cases.
If you have been in a car accident, why wait to find out if you will be a victim of chronic whiplash syndrome. Have your neck checked out by a qualified health care professional and include chiropractic in your therapy.
